Steps for Trademark Registration in UAE

  • Trademark Search : Before applying for registration, it’s advisable to conduct atrademark search in the UAE trademark database. This step helps to check whether theintended trademark or a similar one is already registered or under consideration, thusreducing the risk of objections or legal disputes.
  • Filing the Application : The trademark application is filed with the Ministry ofEconomy. The application should include the trademark logo, details of the goods orservices for which the trademark will be used, and the applicant's details.
  • Examination by the Ministry : After filing, the application is examined by theMinistry of Economy for any conflicts with existing trademarks and compliance with theUAE's trademark laws. The examination process also involves ensuring that the trademarkdoes not violate public morals or the country’s laws.
  • Publication in the Official Gazette : Once the application passes the examinationphase, the trademark is published in the UAE Official Gazette and possibly in two localArabic newspapers. This publication phase allows for any objections to be raised bythird parties within a period, typically 30 days from the date of publication.
  • Objection Period : During the objection period, any party can oppose theregistration of the trademark. If an objection is raised, it must be resolved beforeproceeding. If there are no objections or once objections are settled, the process movesforward.
  • Issuance of Trademark Certificate : If no objections are raised or if resolved, the Ministry issues a certificate of trademark registration. This certificate is thelegal document confirming the trademark’s registration and the owner’s exclusive rightsto it.
  • Renewal and Protection : A registered trademark in the UAE is protected for 10years from the date of registration. It can be renewed for subsequent 10-year periods. The trademark owner is responsible for enforcing their rights and can take legal actionagainst any infringement.
